COMMERCIAL LEASING

What is a lease?

A real property rental agreement or lease is an agreement by which the relationship of landlord and tenant is created. It grants to the tenant the use and possession of property for a specified term. Standard lease agreement and standard lease amendment forms for both the University of California as Lessee and as Lessor have been approved by General Counsel. These standard forms may be used without referral to General Counsel if there are no substantive deviations. If there are substantive deviations or if the rental agreement or lease requires Regental approval, the document must be reviewed by General Counsel.

Why is it so difficult to find office space close to campus?

There is more space available in downtown Berkeley than we've seen in several years, but the vacancy rates are still very low compared to Emeryville, Oakland and San Francisco.  There is such a limited amount of office space near the campus that meets all UC requirements that finding the right space will always be difficult

How long does it typically take to get off-campus space once a request has been made?

This is a difficult question, depending on the availability of space at the time the request is made.  Sometimes, the right amount of space is available in the right part of town, and a deal can be completed in as little as two-three months.  More often, the search for space can take several months, or can even prove to be impossible.  Once space is identified, it can take several months to negotiate the lease agreement, especially in a tight market where landlords are less willing to accept the University's standard form lease.  The space also has to meet UC's seismic safety policy, ADA, and fire & life safety requirements, which makes some buildings close to campus unacceptable for UC to lease.

How much rent should I expect to pay if I need off-campus leased space?

Rents are currently ranging from about $2.35 - $2.95 per rentable square foot per month.

Why does the Berkeley campus lease space?

The Berkeley campus community has outgrown its borders.  Campus space is at a premium.  For a number of years now, the campus has found it necessary to establish administrative and academic programs in off-campus, leased space.

Where are some of the campus' currently leased spaces in Berkeley?

Some of the Berkeley campus' largest lease holds are at 2484 Shattuck Avenue, 1995 University Avenue, 2000 Center Street, 2440 Bancroft Way, 1936 University Avenue, and 2201 Shattuck Avenue.

FACILITY USE PERMITS

What is a FUP?

A Facility Use Permit (FUP) is a contract that allows outside groups to use campus facilities or allows campus groups to use facilities at off-campus locations.

How can I get a Certificate of Insurance for an upcoming event to be held off campus?

If the facility is only asking for "evidence of insurance" and does not require a signed permit, please contact the Risk Management Office and they will provide the necessary insurance documentation.

If the facility requires a signed permit and a Certificate of Insurance naming it as "additionally insured," please complete and send the original permit to the Real Estate Services Office for review and signature.  (Please be sure to include an attached memo indicating your facility representative's name/phone/fax, the purpose of your event, your department's phone/fax, and your BFS chart string to cover our recharge.)  Once the permit is fully signed with language acceptable to both parties, RESO will fax a copy to the requesting campus department and to Risk Management for issuance of the Certificate of Insurance.

CAMPUS FILMING / PHOTO SHOOTS

What are the names of some of the films/television shows that have filmed here on the Berkeley campus?

Junior, Boys & Girls, and Nash Bridges have all filmed scenes on the Berkeley campus.

Does Real Estate Services publicize upcoming movies/filming projects?

Which BFS Account is appropriate for lease payments?

Lease payments are most appropriately charged to BFS Account 56312: "Non-Conference Facil Rent-Off-Campus."  The Long Description: Non-conference facility rental off site.  Cost of renting and maintaining off-campus space as a performance site.  Does not apply to room rental for events, workshop rentals, cylinder rentals or hotel room rentals.

What are some of the kinds of recharges I am likely to see on my department ledgers?

Some typical RESO recharge descriptions numbers are as follows:

  • "LSM: <property address>" - denotes monthly recharges for "lease maintenance".
  • "FUP: <location/event>" - denotes a facility use permit recharge.
RESO recharges are processed via online Financial Journal.  RESO's recharge journal reference numbers are prefaced with "AWASB", followed by the accounting period ("AUG" for August, "SEP" for September...) and "NN" for the fiscal year ending or series sequence number.  

Examples:

  • "AWASBNOV06" - Lease Maintenance recharge for November 2006
  • "AWASBFUPXX" - Facility Use Permit recharges (next in series)
The BFS Account charged for RESO recharges is typically BFS Account 56639: "Misc. Services", unless the department receiving services specifically requests a different BFS Account be used.

How are lease payments processed?

Lease payments are handled by the Real Estate Services Office.  RESO will initiate the necessary Purchase Order (PO).  At the time of initial setup of the PO, RESO will e-mail the Tenant Department all of the relevant information (scheduled payments, voucher numbers, associated PO#, and chart string charged).  Payments are vouchered and approved for the full term of the lease, but not to exceed the current fiscal year.

Example:  If your lease expires on 30 September of the following fiscal year, payments for the current fiscal year would be vouchered and approved from the present day's date through July of the following fiscal year.  (July lease payments are always released on the 25th of June so as not to delay payment to Landlords due to the University fiscal close process.)  While all payments are approved at the time of initial vouchering, they do not actually expense on the leasing department's GL until such time that the payment is actually released (typically the 25th day of the month preceding the month for which rent is due).  Payments for the following fiscal year's rent will be picked up in August.
